Right of Withdrawal and Standard Withdrawal Form

As a consumer, you have the right to withdraw from the SunVolt Club membership contract within 14 calendar days, without giving any reason and without incurring any cost other than what is described below.

The withdrawal period expires 14 calendar days from the day on which the membership contract is concluded, which is the day your 99 EUR membership is confirmed. If the 14th day falls on a weekend or a public holiday, the period runs until the end of the next working day.

This 14-day right concerns your initial purchase. It is separate from cancelling the future automatic renewals of your annual membership, which you can do at any time from your account through the Stripe billing portal, as described in the Terms and Conditions.

To exercise the right of withdrawal, you must inform us of your decision by a clear statement. You can do this in either of the following ways:

• By email to [email protected], stating that you withdraw from the SunVolt Club membership contract.
• By post to SunVolt Energy UAB, Beržų al. 1, Samylų sen., Kauno r., LT-53118, Lithuania.

You may use the standard withdrawal form set out in Section 6 below, but this is not obligatory. Any other clear statement of your decision to withdraw is equally valid. To meet the withdrawal deadline, it is sufficient that you send your communication before the 14-day period has expired.

The burden of proof for exercising the right of withdrawal within the period lies with you, so we recommend keeping a copy of your statement and, where possible, using a means that provides confirmation of sending.

If you withdraw from this contract, we will reimburse you all payments received from you, that is the 99 EUR membership fee, subject to the reduction described in Section 4 where you have requested early performance.

We will make the reimbursement without undue delay and in any event not later than 14 calendar days from the day on which we are informed of your decision to withdraw.

We will carry out the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement.

One of the membership benefits is a professional energy assessment report, which we aim to deliver within 48 hours. Because 48 hours is inside the 14-day withdrawal period, this benefit can only begin if you ask us to start before the period ends.

During enrolment you may expressly request that the performance of the membership services, including preparation and delivery of the energy assessment report, begins before the 14-day withdrawal period expires. If you make this request, you also acknowledge the following:

• You keep your right of withdrawal during the 14-day period.
• If you withdraw after performance has begun, you must pay an amount proportionate to the services actually provided up to the moment you inform us of your withdrawal, compared with the full coverage of the contract. This amount may be deducted from your 99 EUR refund.
• Once the energy assessment report has been delivered to you with your prior express consent and your acknowledgement that you would lose the right of withdrawal for a fully performed service, you accept that the service has been fully performed and that the right of withdrawal may no longer apply to that performed service, as set out in the Terms and Conditions.

If you do not request early performance, no service that must begin inside the withdrawal period will start before the 14 days have passed, and a full 99 EUR refund remains available if you withdraw in time. The detailed rules on proportional deduction and loss of the right for a fully performed service are those stated in the SunVolt Club Terms and Conditions.

When the right of withdrawal does not apply or ceases

The right of withdrawal does not apply, or ceases to apply, in the cases provided by Directive 2011/83/EU, in particular for a service that has been fully performed where performance began with your prior express consent and your acknowledgement that you would lose your right of withdrawal once the contract has been fully performed. This is relevant to the energy assessment report described in Section 4.

The 250 EUR PV system credit, member pricing, group-buying rounds, partner discounts and eligibility to apply for the SunVolt Green Home Award are membership benefits governed by the Terms and Conditions. Withdrawal from the membership contract ends your access to these benefits for the withdrawn membership.
